2. OPĆE ODREDBE
Online trgovina „Hero4Heroes“ je u stopostotnom vlasništvu obrta za modni dizajn Hero4Heroes vl. Marijana Hero (dalje u tekstu Hero4Heroes). Hero4Heroes omogućava korištenje informacija, usluga i sadržaja internetske online trgovine „Hero4Heroes“ koje je regulirano ovim Uvjetima prodaje. Uvjeti prodaje propisuju uvjete i pravila za krajnje korisnike i odnose se na korištenje online trgovine „Hero4Heroes“. Korištenjem internetske stranice, krajnji korisnici potvrđuju da se slažu s Uvjetima prodaje poslovanja i korištenja te pristaju na korištenje internetske online trgovine „Hero4Heroes“ u skladu s njima. Pristup internetskim stranicama „Hero4Heroes“ ponekad može biti nedostupan zbog radova, održavanja ili uvođenja novih sadržaja te u slučajevima nepredviđenih okolnosti koje su izvan kontrole tvrtke Hero4Heroes. Sve poteškoće u ispravnom radu online trgovine ćemo nastojati otkloniti u najkraćem mogućem roku. Korisnik može svoje upite i komentare poslati pisanim putem, poštom ili e-mailom, a Hero4Heroes će poslati pisani odgovor poštom ili e-mailom u predviđenom zakonskom roku.
3. OSNOVNI POJMOVI
U smislu ovih uvjeta prodaje, kupac je fizička ili pravna osoba koja naruči barem jedan proizvod, popuni tražene podatke i plati naručeni proizvod posredstvom online trgovine „Hero4Heroes“. Ukoliko su u podacima o kupcu upisani podaci o pravnoj osobi, tada se kupcem smatra pravna osoba, a fizička osoba čiji su podaci uneseni smatra se ovlaštenom osobom kupca.
4. OSOBNI PODACI I POSLOVNA SPOSOBNOST
Za ispravnu narudžbu proizvoda osoba koja popunjava istu mora biti starija od 18 godina (poslovno sposobna). Kupac snosi odgovornost za točnost i potpunost unesenih podataka prilikom registracije. Online trgovina „Hero4Heroes“ zadržava pravo na izmjenu ovih uvjeta prodaje te iste može promijeniti bez prethodne najave, ali se obvezuje obavijestiti sve registrirane korisnike putem e-mail adresa koje su isti upisali prilikom registracije. Sve eventualne promjene primijenit će se na korištenje stranica online trgovine „Hero4Heroes“.
5. INTELEKTUALNO VLASNIŠTVO
Korisnik prihvaća da je cjelokupan sadržaj web stranica isključivo vlasništvo Hero4Heroes ili njegovih ovlaštenika. Korištenjem web stranica korisniku se daje ograničena, neisključiva, neprenosiva i opoziva dozvola za korištenje sadržaja web stranica. Radi izbjegavanja svake sumnje, Hero4Heroes izričito zadržava i ne prenosi na korisnika bilo koja druga prava u odnosu na sadržaj web stranica “Hero4Heroes”, te zabranjuje korištenje sadržaja web stranica, osim kako je to određeno ovim Uvjetima kupnje. Korisnik osobito nema pravo skidati, umnožavati, mijenjati, uređivati, distribuirati, prikazivati, brisati, slati, prodavati, preprodavati, prilagođavati, mijenjati sadržaj, stvarati izvedenice, uključivati na druge Internet stranice ili medije ili koristiti na bilo koji način osim za osobne svrhe za kućnu uporabu. Ukoliko je to izričito dopušteno na web stranicama, korisnik će imati pravo skidati (“download”) određene sadržaje. U takvom slučaju korisnik se obvezuje da će takav sadržaj koristiti isključivo za osobnu uporabu, te da će u odnosu na takav sadržaj u cijelosti poštivati odredbe ovih Uvjeta prodaje.
6. CIJENA PROIZVODA
„Hero4Heroes“ se obvezuje jasno, vidljivo i čitljivo istaknuti iznos maloprodajne cijene sukladno članku 7. Zakona o zaštiti potrošača (NN 41/14). „Hero4Heroes“ će povremeno, sukladno vlastitim poslovnim odlukama stavljati određene proizvode na akcijsku prodaju po cijeni koja je niža od cijene tih proizvoda u redovnoj prodaji, te se isto obvezuje jasno vidljivo i čitljivo označiti i navesti duljinu trajanja akcijske prodaje. Nakon isteka perioda akcijske prodaje, „Hero4Heroes“ neće primati narudžbe po uvjetima koji se odnose na završene akcije.
7. PODACI O PROIZVODIMA I RASPOLOŽIVOST PROIZVODA
Podaci o proizvodima definirani se u odnosu na informacije proizvođača određenog proizvoda te vlastite baze podataka. Fotografije proizvoda su ilustrativne prirode te ne moraju uvijek i u svim detaljima odgovarati proizvodima koji su predmet narudžbe. Vizualni identitet i izgled proizvoda prikazan na fotografiji ne mora odgovarati izgledu proizvoda u stvarnosti, obzirom na postavke uređaja s kojih se vrše narudžbe, razlike u percepciji boja i sl. U slučaju navedenih razlika između proizvoda prikazanog na fotografiji i isporučenog ne radi se o nedostatku proizvoda. Podaci o proizvodima (opis, tip, vrsta, cijena i dr.) podložni su bugovima, nepravilnostima u radu aplikacije, drugim tehničkim nepravilnostima, tipografskim pogreškama i sl. U slučaju očitih pogrešaka ili neispravnosti u pogledu podataka o proizvodima prikazanih u onlinetrgovini „Hero4Heroes“, zadržava pravo jednostrano raskinuti ugovor. Predmet narudžbe mogu biti samo proizvodi za koje je u narudžbi naznačeno da su raspoloživi na skladištu te proizvodi koji nisu raspoloživi na skladištu, ali su dobavljivi u uz proizvod navedenom roku. U rok se ne ubrajaju subote, nedjelje te neradni dani zbog przanika. Usljed mogućih nedostataka tehnologije (većeg broja istovremenih narudžbi, problema s internetskom vezom i sl.), moguće je da informacija o raspoloživosti proizvoda ne bude istovjetna sa stanjem u skladištu.
8. NARUDŽBA I TRENUTAK SKLAPANJA UGOVORA
Proizvodi se naručuju odabirom, korištenjem menija i popunjavanjem online formulara. Kupac može naručiti i kupiti proizvod kao registrirani ili neregistrirani korisnik. Proizvod se smatra naručenim kada kupac prođe cijeli postupak narudžbe.
Plaćanje naručenih proizvoda moguće je obaviti na slijedeće načine:
• Kreditnom karticom za koju Hero4Heroes ima sklopljen ugovor o prihvaćanju (Visa, Visa Electron, VPay, MasterCard, Maestro, Diners, Discovery, Bc card, i Dina Card kartice,).
• Transakcijski racun
• Općom uplatom i pouzećem (samo unutar Hrvatske)
Narudžba se smatra zaprimljenom:
• U slučaju plaćanja kreditnom karticom – u trenutku kada „Hero4Heroes“ primi potvrdu predautorizacije kreditne kartice kupca na iznos narudžbe.
• U slučaju plaćanja e-bankingom ili općom uplatom – u trenutku kada “Hero4Heroes” elektroničkim putem zaprimi potvrdu o uplati narudžbe.
U trenutku kada je narudžba zaprimljena, “Hero4Heroes” će elektronskim putem u obliku e-maila obavijestiti kupca o tome da je narudžba zaprimljena odnosno da je proizvod uspješno naručen. Ukoliko kupac ne dobije obavijest iz prethodnog stavka, prija upita “Hero4Heroes” poželjno je provjeriti:
• Nije li poruka završila u Junk/Spam folderu.
• Nije li kupcu mailbox pun.
U slučaju plaćanja kreditnom karticom ugovor se smatra sklopljenim u trenutku kada “Hero4Heroes” dobije potvrdu predautorizacije kartice kupca na iznos narudžbe te kada skladištar prilikom pakiranja robe potvrdi da je naručeni proizvod raspoloživ na skladištu. U slučaju plaćanja e-bankingom i općom uplatom, ugovor se smatra sklopljenim u trenutku kada “Hero4Heroes” zaprimi potvrdu da je iznos narudžbe uplaćen. Ukoliko je proizvod naručen, a kao način plaćanja je odabran e-banking ili opća uplata, “Hero4Heroes” se obvezuje rezervirati proizvod na skladištu u trajanju od 48 sati. Nakon isteka 48 sati od primitka narudžbe, “Hero4Heroes” ne jamči za raspoloživost proizvoda.
9. NAČIN KUPNJE NA WEB SHOPU
Odabirom proizvoda klikom na sliku otvara se podprozor s proizvodom, opisom, cijenom, informacijom o dostavi i reklamaciji. Cijene istaknute na stranicama pored pojedinog proizvoda vrijede za sve oblike plaćanja. Cijene su sa uključenim PDV-om. Klikom na gumb “Dodaj u košaricu”, proizvod se stavlja u “Košaricu”. Pristupom meniju „Košarica“ kupac dobija uvid u odabrane proizvode, njihovu količinu i cijenu. Proizvod uvršten u „Košaricu“ kupuje se klikom na tipku „Na blagajnu“. Nakon pritiska na tipku „Na blagajnu“, kupac pristupa u obrazac narudžbe u koji ste dužni upisati osobne podatke. Ukoliko se osobni podaci kupca razlikuju od osobnih podataka primatelja dužni ste odabirom navedene opcije točno naznačiti i podatke primatelja. Prilikom narudžbe pored svakog proizvoda biti će naznačena cijena poštarine. Cijena poštarine nije uključena u cijenu proizvoda. Nakon primitka podataka iz narudžbe, na ekranu će biti istaknuta obavijest da je narudžba kupca zaprimljena, a kupac će o primitku narudžbe dobiti posebnu obavijest elektronskim putem na naznačenu e-mail adresu. Ukoliko je kao oblik plaćanja odabrano plaćanje e-bankingom ili općom uplatnicom, a “Hero4Heroes” ne raspolaže naručenim proizvodom na skladištu, o tome će u primjerenom roku kupac biti obaviješten te će “Hero4Heroes” izvršiti povrat uplaćenih novčanih sredstava. U slučaju gore navedene uplate, kupac odgovara i snosi rizik za točnost i istinitost dostavljenih podataka s obzirom na to da će “Hero4Heroes” izvršiti povrat sredstava sukladno upisanim podacima.
10. NAPLATA / AUTORIZACIJA
Sve cijene izražene su u Eurima (€). U slučaju plaćanja e-bankingom i općom uplatnicom, troškovi uplate i/ili međubankarske transakcije nisu uključeni u cijenu.
11. IZJAVA O SIGURNOSTI PLACANJA
Hero4Heroes koristi WSPay za online plaćanja. WSPay je siguran sustav za online plaćanje, plaćanje u realnom vremenu, kreditnim i debitnim karticama te drugim načinima plaćanja. WSPay kupcu i trgovcu osiguravaju siguran upis i prijenos upisanih podataka o karticama što podvrđuje i PCI DSS certifikat koji WSPay ima. WSPay koristi SSL certifikat 256 bitne enkripcije te TLS 1.2 kriptografski protokol kao najviše stupnjeve zaštite kod upisa i prijenosa podataka.Unos i prijenos osobnih podataka i podataka o broju kreditne kartice zaštićen je najvišim sigurnosnim standardima koje osigurava WSPay sustav za on-line autorizaciju kreditnih kartica u skladu sa zahtjevima kartičara i kartičarskih brendova te PCI DSS standarda. Autorizacija i naplata kreditnih kartica radi se korištenjem sustava WSPay za autorizaciju i naplatu kartica u realnom vremenu.
12. NAČIN PLAĆANJA
Kupac može izvršiti plaćanje naručenih proizvoda jednom od sljedećih metoda plaćanja:
• Internet bankarstvom / bankovnim prijenosom
• Općom uplatnicom
• Plaćanjem pouzećem (dostupno isključivo na području Republike Hrvatske)
• Kreditnim i debitnim karticama (Visa, Mastercard, Maestro, Diners i druge podržane kartice)
• Obročnim plaćanjem za odabrane kartice (do 12 rata, ovisno o uvjetima kartične kuće i banke, dostupno u Hrvatskoj)
• Apple Pay
• Klarna (dostupna u odabranim državama i ovisno o dostupnosti usluge)
• iDEAL (dostupan u Nizozemskoj)
• Swish (dostupan u Švedskoj)
• KEKS Pay
• PayPal
Plaćanje karticama izvršava se putem sigurnih online sustava za autorizaciju i naplatu kartica.
DOSTUPNOST METODA PLAĆANJA
Dostupne metode plaćanja ovise o državi dostave, valuti, tehničkoj dostupnosti pojedinog pružatelja platnih usluga te drugim uvjetima i ograničenjima koje određuju pružatelji usluga plaćanja. Prodavatelj zadržava pravo u bilo kojem trenutku omogućiti, ograničiti ili ukloniti pojedine metode plaćanja bez prethodne obavijesti. Kupcu će tijekom procesa narudžbe (checkouta) biti prikazane isključivo metode plaćanja dostupne za njegovu lokaciju i narudžbu.
13. IZJAVA O KONVERZIJI
Za kupnje na stranicama www.hero4heroes.com sva plaćanja biti će realizirana u Eurima (€). Na računu koji ćete dobiti od Vaše kartične kuće isti iznos biti će pretvaren u lokalnu valutu prema tečaju kartične kuće. Kao rezultat ove konverzije postoji mogućnost pojave razlike u cijenama u odnosu na cijene navedene na našim web stranicama.
14. KORIŠTENJE KUPONA I POPUSTA
Našim Facebook prijateljima i newsletter pretplatnicima povremeno darujemo kupon za posebne promocije, pogodnosti i sniženja. Kupon je najčešće jedna riječ ili niz znakova. Za obračun popusta upišite točan tekst i/ili znakove na kuponu, potvrdite ga – i popust će se automatski obračunati. Polje za upis kupona nalazi se u „Košarici“ u trećem koraku procesa plaćanja. Dakle, iskoristite ove pogodnosti neposredno prije nego završite kupovinu. Kuponi mogu biti ograničeni trajanjem i brojem korištenja. Također popusti mogu biti primijenjeni samo na jedan proizvod, na ograničen izbor proizvoda ili akciju. Sva pravila popusta bit će jasno naznačena prilikom slanja kupona. U slučaju korištenja različitih popusta, oni se ne zbrajaju već se samo jedan uzima u obzir.
15. DOSTAVA
Proizvode je moguće naručiti za dostavu na području cijelog svijeta, prema uvjetima koji vrijede za svako područje dostave, a ovise o načinu slanja.

- Besplatna do 3 radna dana za područje Hrvatske, osim ako nije drukčije istaknuto uz proizvod.
- Besplatna do 7 radnih dana za područje otoka, osim ako nije drukčije istaknuto uz proizvod
OSTATAK EVROPE:
- Besplatna 5-7 radnih dana, osim ako nije drukčije istaknuto uz proizvod
OSTATAK SVIJETA:
- 40€ trošak dostavem, do 25 radnih dana, osim ako nije drukčije istaknuto uz proizvod
Dostava se obavlja dostavnom službom po izboru Hero4Heroes. Moguće je dogovoriti dostavu po želji kupca ukoliko kupac prije narudžbe postavi upit za željenu opciju dostave putem e-maila: info@hero4heroes.com U cijenu dostave uključeno je pakiranje proizvoda. U cijenu proizvoda nije uključena dostava, osim ukoliko nije drukčije naznačeno (naznaka „besplatna dostava“). Dostava se obavlja sukladno uvjetima dostavne službe, a smatra se izvršenom u trenutku predaje proizvoda dostavne službe. Ako se proizvod koji je upućen kupcu odnosno primatelju vrati u “Hero4Heroes” jer nije uspjela izvršiti dostavu, kupac će o tome biti obaviješten e-mailom. Međunarodne narudžbe mogu biti podložne uvoznim carinama, carinskim pristojbama i lokalnim porezima nakon što stignu u odredišnu zemlju.Te troškove određuje lokalna carinska uprava i odgovornost su kupca.Ne pokrivamo niti vraćamo nikakve carine, poreze ili uvozne pristojbe.
16. MATERIJALNI NEDOSTACI PROIZVODA (ODGOVORNOST ZA MATERIJALNE NEDOSTATKE)
“Hero4Heroes” odgovara za materijalne nedostatke i nesukladnost proizvoda prodanih na svojim stranicama u skladu s pozitivnim propisima Republike Hrvatske, posebice Zakonom o obveznim odnosima i Zakonom o zaštiti potrošača. Naručeni proizvodi pakiraju se na način da se tijekom uobičajene manipulacije u transportu i dostavi ne oštete. Ako je pošiljka vidljivo oštećena prilikom preuzimanja (npr. potrgana ili ulupljena ambalaža), kupcu se preporučuje da takvo oštećenje odmah reklamira dostavljaču (kuriru) koji je robu dostavio te da nas bez odgađanja kontaktira na e-mail: info@hero4heroes.com kako bismo problem riješili u najkraćem roku. U slučaju materijalnog nedostatka ili nesukladnosti proizvoda, kupac ima prava u skladu sa Zakonom o obveznim odnosima. Kupac ima pravo zahtijevati otklanjanje nedostatka (popravak), zamjenu proizvoda za novi, proporcionalno sniženje cijene ili raskid ugovora uz povrat novca, a sve pod uvjetima i redoslijedom propisanim važećim zakonom.
17. UPITI, PISANI PRIGOVORI I REKLAMACIJE
Upite o proizvodima, kao i formalne prigovore, pohvale i komentare, kupci mogu podnijeti putem elektroničke pošte na adresu: info@hero4heroes.com ili u pisanom obliku na našu službenu adresu: Hero4Heroes, obrt za modni dizajn i izradu rukotvorina, Put Brdo 18, 51211 Matulji, Hrvatska. U skladu s člankom 11. Zakona o zaštiti potrošača, “Hero4Heroes” će bez odgađanja pismeno potvrditi primitak svakog pisanog prigovora. Službeni pismeni odgovor na prigovor kupcu će biti dostavljen putem e-maila ili redovne pošte najkasnije u roku od 15 dana od dana zaprimanja prigovora. Kako bi se prigovor što brže riješio, kupac se moli da u prigovoru navede broj narudžbe, broj računa ili podatke o svom korisničkom računu, detaljan opis nedostatka te, ako je moguće, fotografiju nedostatka ili oštećenja.
18. PRAVO NA JEDNOSTRANI RASKID UGOVORA

Unosom ispravnog broja narudžbe i pripadajuće e-mail adrese, sustav će Kupcu na e-mail automatizmom poslati izravnu digitalnu formu za podnošenje zahtjeva.Nakon što Kupac preda ispunjeni digitalni obrazac (bilo putem korisničkog računa ili putem forme poslane na e-mail), “Hero4Heroes” će bez odgađanja Kupcu dostaviti potvrdu primitka obavijesti o raskidu ugovora elektroničkom poštom (e-mailom).Kupac ugovor može raskinuti i slanjem bilo koje druge nedvosmislene izjave poslane poštom ili elektroničkom poštom na našu službenu adresu, u kojoj navodi svoje podatke i podatke o narudžbi.Povrat robe i troškovi:Kupac je dužan robu vratiti bez nepotrebnog odgađanja, a u svakom slučaju najkasnije u roku od 14 dana od dana kada je uputio svoju odluku o jednostranom raskidu ugovora.Izravne troškove povrata robe snosi Kupac sam.Kupac je odgovoran za svako umanjenje vrijednosti robe koje je rezultat rukovanja robom, osim onog koje je bilo potrebno za utvrđivanje prirode, obilježja i funkcionalnosti robe.Povrat uplaćenog iznosa:Ako Kupac jednostrano raskine ovaj ugovor, “Hero4Heroes” se obvezuje izvršiti povrat novca koji je primio, uključujući i troškove standardne isporuke, bez odgađanja, a najkasnije u roku od 14 dana od dana kada smo zaprimili obavijest o odluci o raskidu ugovora.”Hero4Heroes” može zadržati povrat novca tek nakon što nam roba bude vraćena ili nakon što nam bude dostavljen dokaz da je roba poslana natrag (ovisno o tome što nastupi ranije).Povrat novca bit će izvršen na isti način na koji je izvršena uplata. U slučaju da kupac izričito pristaje na drugi način povrata plaćenog iznosa, ne snosi nikakve troškove povezane s povratom.
19. PRIMJENA UVJETA PRODAJE
Korištenjem usluga “Hero4Heroes” prihvaćate ove Uvjete prodaje. Ako niste suglasni s uvjetima, nemojte koristiti ove stranice niti putem njih naručivati proizvode. Ova web stranica sadrži informacije o proizvodima i uslugama “Hero4Heores” te služe kao elektroničko prodajno mjesto – online trgovina. “Hero4Heroes” ne odgovara za eventualnu štetu nastalu korištenjem ove web stranice te korištenjem informacija s ove web stranice u svrhe koje izlaze izvan okvira njihove predviđene namjene te uslijed neautoriziranog korištenja korisničkog imena i lozinke ili je povezana sa takvim korištenjem, “Hero4Heroes” ne snosi odgovornost za bilo koju štetu koja bi mogla nastati zbog prekida internetske veze prilikom korištenja webshop usluge.
20. ZAVRŠNE ODREDBE
Prihvaćanjem ovih uvjeta prodaje kupac pristaje na odredbe ovih uvjeta te prihvaća da oni čine sastavni dio ugovora. “Hero4Heroes” zadržava pravo izmijeniti ove Uvjete prodaje bez prethodne najave. Registrirani korisnici su dužni prilikom svakog korištenja web stranica, te posebno webshop usluge provjeriti važeće Uvjete prodaje. Važeći opći uvjeti bit će objavljeni na web stranicama. Za korištenje usluga važeći su Uvjeti prodaje u trenutku primitka cijene za naručeni proizvod. Svi sporovi koji mogu nastati temeljem ovih Uvjeta prodaje rješavat će se pred nadležnim sudom u Rijeci.

Hero4Heroes allows the use of information, services, and content of the “Hero4Heroes” online store, which is governed by these Terms of Sale. The Terms of Sale set the conditions and rules for end users and apply to the use of the “Hero4Heroes” online store. By using the website, end users confirm that they agree to the Terms of Sale and agree to use the “Hero4Heroes” online store in accordance with them. Users can send inquiries and comments in writing by mail or email, and Hero4Heroes will send a written response by mail or email within the legally prescribed time frame.
3. DEFINITIONS
For the purposes of these Terms and Conditions, a buyer is any individual or legal entity that orders at least one product, provides the required details, and pays for the product through the “Hero4Heroes” online store. If the buyer’s details include those of a legal entity, the legal entity is considered the buyer, while the individual providing the details is considered an authorized representative of the buyer.
4. PERSONAL DATA AND LEGAL CAPACITY
To place a valid order, the individual completing the order must be at least 18 years old (legally competent). The buyer is responsible for the accuracy and completeness of the data entered during registration. The “Hero4Heroes” online store reserves the right to modify these Terms of Sale without prior notice but will notify all registered users via the email addresses provided during registration. Any changes will apply to the use of the “Hero4Heroes” online store.
5. INTELLECTUAL PROPERTY
The user acknowledges that all content on the website is the exclusive property of Hero4Heroes or its licensors. By using the website, users are granted a limited, non-exclusive, non-transferable, and revocable license to use its content. For avoidance of doubt, Hero4Heroes retains and does not transfer any other rights concerning the content of the “Hero4Heroes” website. The use of website content is prohibited except as explicitly defined in these Terms and Conditions. Users, in particular, are not allowed to download, reproduce, modify, edit, distribute, display, delete, send, sell, resell, adapt, change, create derivative works, integrate into other websites or media, or use the content for any purpose other than personal and household use. If explicitly allowed on the website, users may download specific content. In such cases, users agree to use the content solely for personal use and comply fully with these Terms and Conditions.
6. PRODUCT PRICING
Hero4Heroes is committed to displaying the retail price clearly, visibly, and legibly in accordance with Article 7 of the Croatian Consumer Protection Act (NN 41/14). From time to time, Hero4Heroes may place certain products on promotional sales with prices lower than the regular prices, clearly marking such items and indicating the duration of the promotional sale. After the promotional period, Hero4Heroes will not accept orders under the conditions of the expired promotion.
7. PRODUCT INFORMATION AND AVAILABILITY
Product information is defined based on the manufacturer’s details of a specific product and Hero4Heroes’ own database. Product images are illustrative and may not always fully correspond to the actual products ordered. The visual identity and appearance of products shown in photographs may differ from their actual appearance due to device settings, color perception, etc. In the case of differences between the product shown in a photograph and the delivered product, such differences do not constitute a product defect. Product data (description, type, price, etc.) may be subject to errors, application bugs, or other technical inaccuracies. In the event of obvious errors or inaccuracies regarding product data displayed in the online store, Hero4Heroes reserves the right to unilaterally terminate the contract. Only products marked as available in stock or as deliverable within a specified time period can be ordered. Saturdays, Sundays, and public holidays are not included in the delivery time frame. Due to technological limitations (e.g., a large number of simultaneous orders, internet connection problems, etc.), information on product availability may not always match actual stock status.
8. ORDERING AND CONTRACT FORMATION
Products are ordered by selecting items, navigating the menu, and completing an online form. Customers can order and purchase products either as registered or non-registered users. A product is considered ordered once the customer completes the entire ordering process. Payment for ordered products can be made in the following ways:
- Credit card accepted by Hero4Heroes (Visa, Visa Electron, VPay, MasterCard, Maestro, Diners, Discovery, BC Card, and Dina Card).
- Bank transfer
- General payment slip or cash on delivery (available within Croatia only).
An order is considered received:
- In the case of credit card payments: upon Hero4Heroes receiving confirmation of the pre-authorization of the customer’s credit card for the order amount.
- In the case of e-banking or general payment slips: upon Hero4Heroes electronically receiving confirmation of the payment.
When an order is received, Hero4Heroes will notify the customer electronically via email, confirming that the order has been successfully placed. If the customer does not receive this notification, they are advised to:
- Check the Junk/Spam folder of their email account.
- Verify that their email inbox is not full.
In the case of credit card payments, the contract is considered concluded at the moment Hero4Heroes receives confirmation of the pre-authorization of the customer’s credit card and the warehouse confirms the product’s availability during packaging. In the case of e-banking or general payment slips, the contract is considered concluded once Hero4Heroes receives confirmation that the order amount has been paid. If a product is ordered, and the payment method chosen is e-banking or a general payment slip, Hero4Heroes will reserve the product in stock for 48 hours. After this period, Hero4Heroes cannot guarantee the availability of the product.
9. PURCHASING PROCESS ON THE WEB SHOP
By clicking on a product image, a sub-window opens, displaying the product, description, price, delivery, and return information. Prices displayed on the product pages are valid for all payment methods and include VAT. By clicking the “Add to Cart” button, the product is added to the “Cart.” By accessing the “Cart” menu, the customer can review the selected products, their quantities, and prices. Products added to the “Cart” are purchased by clicking the “Checkout” button. After pressing “Checkout,” the customer is taken to the order form, where they must enter their personal details. If the recipient’s details differ from the customer’s, the customer must indicate this in the specified section. Shipping costs for each product will be indicated during the ordering process. Shipping costs are not included in the product price unless otherwise specified. Once the order is submitted, the customer will receive a notification on the screen that their order has been received. Additionally, a confirmation email will be sent to the email address provided during the order. If payment is made via e-banking or general payment slips, and Hero4Heroes does not have the product in stock, the customer will be notified promptly, and Hero4Heroes will refund the paid amount. In such cases, the customer is responsible for providing accurate and truthful information, as Hero4Heroes will refund the amount based on the provided details.
10. PAYMENT / AUTHORIZATION
All prices are expressed in Euros (€). For e-banking and general payment slips, transfer costs and/or interbank transaction fees are not included in the price.
11. PAYMENT SECURITY STATEMENT
Hero4Heroes uses WSPay for online payments. WSPay is a secure system for online payments, providing real-time payment processing for credit and debit cards, as well as other payment methods. WSPay ensures secure entry and transfer of cardholder data, verified by the PCI DSS certificate. WSPay uses a 256-bit SSL certificate and TLS 1.2 cryptographic protocol to provide the highest level of security for data entry and transfer. Personal data and credit card information are protected according to the highest security standards required by card networks and PCI DSS standards. Authorization and payment of credit cards are processed through the WSPay system in real time.

The Seller reserves the right to enable, limit, or remove certain payment methods at any time without prior notice. Only payment methods available for the customer’s location and order will be displayed during the checkout process.
13. STATEMENT ON CURRENCY CONVERSION
For purchases on the website www.hero4heroes.com, all payments will be processed in Euros (€). The invoice from your card issuer will display the equivalent amount converted into your local currency at the card issuer’s exchange rate. As a result, there may be differences in pricing compared to the amounts displayed on our website.
14. USE OF COUPONS AND DISCOUNTS
Occasionally, we offer coupons to our Facebook friends and newsletter subscribers for special promotions, benefits, and discounts. A coupon is usually a word or a series of characters. To redeem a discount, enter the exact text and/or characters on the coupon and confirm it. The discount will automatically be applied. The coupon entry field is located in the “Cart” section, during the third step of the checkout process. Take advantage of these benefits before completing your purchase. Coupons may be limited in duration and usage. Discounts may also apply to a single product, a limited selection of products, or a specific promotion. All discount rules will be clearly specified when the coupon is sent. When using multiple discounts, they cannot be combined; only one discount will apply.
Products can be ordered for delivery worldwide, under the conditions applicable to each delivery area, depending on the shipping method.

Shipping is handled by a courier service of Hero4Heroes’ choice. It is possible to arrange for a different delivery option if the buyer contacts Hero4Heroes before placing the order by email at info@hero4heroes.com. The cost of packaging is included in the shipping fee. The cost of delivery is not included in the product price unless stated otherwise (e.g., “free shipping”). Delivery is considered complete once the product is handed over to the courier service. If the product is returned to Hero4Heroes because delivery to the buyer or recipient failed, the buyer will be notified via email. International orders may be subject to import duties, customs fees and local taxes once they arrive in the destination country.These charges are determined by the local customs authority and are the responsibility of the customer.We do not cover or refund any customs duties, taxes or import fees.
16. MATERIAL DEFECTS OF PRODUCTS
Hero4Heroes is responsible for material defects and lack of conformity of products sold on its website in accordance with the applicable laws of the Republic of Croatia, particularly the Obligations Act and the Consumer Protection Act. Ordered products are packaged to ensure they are not damaged during transport and delivery under normal handling. If the shipment is visibly damaged in transit (e.g., torn or dented packaging upon delivery), the buyer is advised to immediately report such damage to the courier and contact us at info@hero4heroes.com without delay so we can address the issue promptly. In the event of a material defect or lack of conformity of the product, the buyer has rights in accordance with the Obligations Act. In case of a defect, the buyer is entitled to request that Hero4Heroes repairs the product, replaces it, reduces the price proportionally, or terminates the contract with a full refund, under the conditions and in the order prescribed by the applicable law.
17. INQUIRIES, WRITTEN COMPLAINTS, AND RECLAMATIONS
Inquiries about products, as well as formal complaints and comments, can be submitted via email at info@hero4heroes.com or in writing to our official address: Hero4Heroes, Fashion Design Craft Business, Put Brdo 18, 51211 Matulji, Croatia. In accordance with Article 11 of the Croatian Consumer Protection Act, Hero4Heroes will acknowledge receipt of any written complaint without delay. A formal written response to the complaint will be provided to the buyer via email or regular mail no later than 15 days from the day the complaint was received. To expedite the resolution of any complaint, the buyer is kindly requested to provide the order number, invoice number, or their user account details, along with a detailed description of the issue and, if possible, photographs of the defect or damage.
18. RIGHT TO UNILATERAL CONTRACT WITHDRAWALA
Buyer who has the status of a consumer has the right, without stating any reasons, to unilaterally withdraw from the sales contract within 14 days from the day when the goods covered by the contract were delivered into the possession of the Buyer or a third party designated by the Buyer (other than the carrier).The Buyer does not have the right to unilaterally withdraw from the contract in cases prescribed by Article 86 of the Consumer Protection Act, particularly if the subject of the contract is sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery, as well as goods which are, after delivery, according to their nature, inseparably mixed with other items.How to Exercise the Right to Unilateral Contract Withdrawal:To exercise the right to unilaterally withdraw from the contract before the expiration of the 14-day period, the Buyer can use the dedicated digital system on our webshop:Registered Users: A Buyer who has an active customer account can withdraw from the contract directly within their profile, under the order history overview, by clicking the contract withdrawal button (“Withdrawal / Raskid ugovora”).Non-registered Users (Guests): A Buyer who completed the purchase as a guest can initiate the process by clicking the “CONTRACT WITHDRAWAL / RASKID UGOVORA” link in the footer of the website. Upon entering the correct order number and the associated email address, the system will automatically send a direct digital form to the Buyer’s email address to submit the formal request.Once the Buyer submits the completed digital form (either via the customer account or via the form sent to their email), “Hero4Heroes” will without delay provide the Buyer with a confirmation of receipt of the withdrawal notice via electronic mail (email).The Buyer may also withdraw from the contract by sending any other unequivocal statement via regular mail or email to our official address, stating their personal details and order information.Return of Goods and Costs:The Buyer must return the goods without undue delay, and in any event no later than 14 days from the day on which the Buyer communicated the decision to unilaterally withdraw from the contract.The direct costs of returning the goods shall be borne solely by the Buyer.The Buyer is liable for any diminished value of the goods resulting from the handling of the goods other than what was necessary to establish the nature, characteristics, and functioning of the goods.Refund of Paid Amount:If the Buyer unilaterally withdraws from this contract, “Hero4Heroes” undertakes to refund all payments received, including the costs of standard delivery, without undue delay and no later than 14 days from the day we received the notification of the decision to withdraw from the contract.”Hero4Heroes” may withhold the refund until we have received the goods back or until the Buyer has supplied evidence of having sent back the goods (whichever occurs earliest).The refund will be issued using the same means of payment as used for the initial transaction. 19. APPLICATION OF TERMS OF SALE
By using the services of Hero4Heroes, you accept these Terms of Sale. If you do not agree with the terms, do not use the website or place orders through it. This website contains information about Hero4Heroes’ products and services and serves as an electronic sales platform – an online store. Hero4Heroes is not responsible for any damage arising from the use of this website or from using the information provided on the site for purposes beyond its intended use. Hero4Heroes is also not responsible for unauthorized use of usernames and passwords or any consequences related to such use. Hero4Heroes is not liable for any damages that may result from interruptions in the internet connection while using the web shop service.
20. FINAL PROVISIONS
By accepting these Terms of Sale, the buyer agrees to the provisions of these terms and acknowledges that they are an integral part of the contract. Hero4Heroes reserves the right to amend these Terms of Sale without prior notice. Registered users are required to review the current Terms of Sale each time they use the website, particularly the web shop service. The applicable general terms will be published on the website. For services, the applicable Terms of Sale are those valid at the time of payment for the ordered product. All disputes arising from these Terms of Sale will be resolved before the competent court in Rijeka, Croatia.
